Commentary by Attorney Michael Grossman

When it comes to alcohol-related accidents, folks tend to assume things are open-and-shut. The reality is they’re often very challenging. I’ve handled hundreds of alcohol-related accident cases, and I rarely see authorities take the steps to find out where the alcohol came from. Why does that matter? Simply put, there could be a negligent alcohol provider who contributed to the accident.

Alcohol providers in Texas who over-served obviously intoxicated persons are doing so unlawfully. This can expose them to potential criminal investigations, fines, suspended licenses, and liability if people are harmed due to the intoxicated. Not only can this help ensure there’s accountability for the accident, it can help put those establishments on the straight-and-narrow before their actions get anyone else hurt.

That’s why I take preliminary investigations into alcohol-related accidents with a grain of salt. Maybe authorities have been working to retrace the alleged drunk driver’s steps and get the whole story. In my experience, though, taking that for granted is a surefire way to end up with only half of the story.
