Fort Worth, TX — May 25, 2024, Rosa Barron was killed as the result of an alleged drunk driver accident at around 12:24 a.m. along N.W. 28th Street.

Authorities said that the incident happened in the area of the Northwest 28th Street and Prospect Avenue intersection.

According to officials, 55-year-old Rosa Ana Barron was on foot and reportedly crossing the roadway. While doing so, a westbound Ford Fiesta whose driver allegedly may have been drinking struck Barron. As a result, Barron was killed. The driver was recommended to face a charge for intoxication manslaughter.

If all of this is true, it raises a vital question I have yet to see authorities answer: was the driver drinking at a local bar prior to the accident? Here’s why that matters. A lot of deadly accidents caused by drunk drivers involve negligent alcohol providers. It’s illegal for alcohol providers to over-serve customers, which opens the establishment up to criminal investigations, potential fines and license suspensions, and liability for the harm resulting from the intoxicated person.

Unfortunately, that’s not something that authorities tend to treat as a high priority. If they have a driver they can charge, that’s often as far as their investigations go. In a lot of the hundreds of cases I’ve had against negligent alcohol providers, few involved authorities taking the steps on their own to look into those establishments. It usually took us handing them evidence we found in our own investigations to get the ball rolling.

Maybe this situation is different entirely, or maybe authorities have already been thorough in finding out all that led up to this incident. That said, experience taught me long ago that waiting around for answers is often a sure way to end up with an incomplete story. Thorough independent investigations can help to catch whatever authorities might let slip through the cracks.
