Commentary by Attorney Michael Grossman
People might think crashes like this one are straightforward cases of driver error, such as following too closely or not reacting quickly enough. However, in my experience, rear-end collisions involving commercial vehicles like box trucks often require deeper investigation to fully understand what went wrong.
A critical question is why the pickup truck collided with the rear-end of the box truck. Investigators should explore whether distraction, speeding, or another factor caused the driver of the pickup to misjudge the situation. Additionally, it’s important to examine whether the box truck was operating appropriately at the time of the crash. For instance, was it traveling at a safe and predictable speed? Did it suddenly brake or slow for reasons that might have contributed to the collision? Dashcam footage and event recorder data could provide crucial insights into these aspects.
The condition of the vehicles involved is also a key area of focus. Both pickup trucks and commercial vehicles require regular maintenance to ensure their safe operation. Investigators should confirm whether the box truck’s lights, reflectors, and other safety features were functioning properly, especially given their importance in alerting following drivers. If any mechanical issues contributed to the crash, the responsibility could extend to the box truck’s operator or owner.
Finally, the trucking company operating the box truck may warrant scrutiny. Companies are responsible for ensuring their vehicles are safe to operate and their drivers are well-trained and adhere to safe driving practices. If lapses in maintenance, training, or oversight are discovered, it’s possible the company could share responsibility for the outcome of the collision.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to consider every factor to ensure that those impacted by the accident receive the clarity and closure they deserve.
