Commentary by Attorney Michael Grossman

With any serious car accident, it’s important to ensure there is enough evidence to tell the whole story. It might surprise folks how often authorities simply speak to people on the scene before moving on. I’m not saying that happened here, but it’s a concern to keep in mind. In fact, it can be helpful to consider some key questions about the investigations early on.

First, did investigators have the time, training, and equipment to fully document the crash scene? Fatal car accidents are often complex and require careful analysis of vehicle positions, sight lines, and road conditions. If any of those elements were overlooked, the investigations may be incomplete.

Second, has anyone looked into whether a mechanical failure or other vehicle defect played a role? Issues like brake failure, steering problems, or tire blowouts can contribute to crashes. Additionally, if seatbelts or airbags didn’t function properly, otherwise survivable injuries may have turned fatal These factors are often missed without a detailed inspection early on.

Lastly, did authorities work to collect and preserve electronic data? Many vehicles carry event data recorders that can capture speed, braking, and other inputs leading to the accident. Combined with surveillance footage or GPS data, this information can help establish a clearer picture of what occurred than simple examination of the scene may provide.

Generally speaking, if authorities are answering these sorts of questions, it’s a sign they’re conducting good investigations. Otherwise, if there are shortcomings or gaps in the story, there may need to be more thorough investigations to bring the whole story to light.
