Commentary by Attorney Michael Grossman

Believe it or not, single-vehicle wrecks are some of the most complex to investigate—not necessarily because they’re caused by hard-to-detect factors, but more because people often reach their own conclusions without waiting for the facts to tell the story. Theories always about that the driver was speeding, or texting, or intoxicated, but the reality is that a vehicle might lose control for all kinds of reasons. Unfortunately, authorities aren’t always equipped to look into every possibility.

I always go back to the infamous “ignition switch” scandal GM had years ago. A critical part had a defect that could leave drivers suddenly without power, meaning they lost things like anti-lock braking, power steering, and even their airbags while their vehicles were in motion. It caused over a hundred deaths, but nobody figured out the issue for years. It was only after forensic investigators finally connected the dots that the defect was discovered and the company was held accountable.

That’s why I always advocate careful investigations after any crash. How many people with GM and Chevy vehicles were accused of being careless when in reality they had no way of avoiding their crashes? Maybe nothing like that happened in San Antonio, but it’s important to keep in mind how many additional factors could be involved rather than just blaming the driver and calling it a day.
