Commentary by Attorney Michael Grossman
A semi-truck crossing into oncoming traffic and causing a fatal crash clearly indicates something went very wrong. Could it be something sudden and unavoidable occurred? Or, could it be that someone’s mistake led to the crash? My concern is that the likelihood of this being the result of driver error could distract authorities from mistakes made long before anyone involved here got behind the wheel.
I’ve handled hundreds of commercial vehicle accidents over my career, and rarely does something this serious involve a sole individual’s isolated mistake. For example, one potential factor is the pressure placed on truck drivers to meet unreasonable delivery deadlines. Companies often push drivers to adhere to demanding schedules, which can lead to fatigue and poor decision-making on the road. Was the driver overworked or sleep-deprived? Were they looking at their GPS while driving or communicating with an overly demanding dispatch? Does this driver’s employer have a history of drivers making mistakes which could point to a culture of prioritizing speed over safety?
Additionally, training and supervision provided by trucking companies can also play a crucial role in preventing deadly truck wrecks. Some companies only care about having bodies behind the wheel and neglect to take the time to ensure drivers are well trained, qualified, or otherwise able to do their jobs safely. As a result, companies can put reckless drivers out on the road, ignoring the risk they pose to others. Was this driver qualified? Were there any signs an accident like this might happen eventually? And if so, why didn’t anyone do anything to prevent it?
These are the types of questions that often go unasked in the immediate aftermath of a crash. Authorities might focus on the driver’s immediate actions without delving into the broader context that may have influenced those actions. Not only could that leave a victim’s loved ones with an incomplete picture of what went wrong, it can potentially let a wrongdoer off the hook despite their role in someone losing their life. So while I certainly don’t know what happened in this crash, my experience tells me there’s likely a lot more below the surface which has yet to get the attention it deserves.
