Commentary by Attorney Michael Grossman
When a pedestrian is struck and injured, especially under allegations of drunk driving, it’s important to look closely at all the factors that may have contributed to the crash. In this case, authorities allege the driver of the Ford Fusion was under the influence, which raises significant questions about where she had been drinking and how she came to be behind the wheel in that condition.
Under Texas law, alcohol providers have a legal obligation to refuse service to patrons who are obviously intoxicated. If the driver had been drinking at a bar, restaurant, or similar establishment prior to the collision, it’s essential to investigate whether that establishment overserved her. If so, they could share responsibility for the pedestrian’s injuries under Texas dram shop law.
Dram shop laws are a key tool in promoting accountability and public safety. They hold alcohol providers responsible when they serve intoxicated patrons who later cause harm. By discouraging reckless alcohol service, these laws help reduce the number of preventable crashes and injuries on Texas roads.
For the injured pedestrian, getting the full truth about what led to this crash is critical—not just to pursue accountability but to help prevent future incidents. Investigating where the driver had been drinking and whether the law was followed is an important step toward ensuring that everyone who played a role in this incident is held responsible. Accountability at every level is vital to making our roads safer for pedestrians and drivers alike.
