Commentary by Attorney Michael Grossman
If reports here are true, then it’s not surprising to see authorities pursuing charges for something as serious as alleged drunk driving. Unfortunately though, it wouldn’t be surprising if authorities’ efforts failed to catch a likely accomplice often involved in these kinds of accidents: an alcohol provider.
Simply put, I’ve handled hundreds of cases involving negligent alcohol providers who unlawfully over-served someone who then caused a serious accident. Texas law allows for these negligent alcohol providers to face potential criminal investigations, fines, license suspensions, and liability for resulting injuries when they over-serve people, yet authorities tend to move on once a drunk driver is being charges. As such, these negligent alcohol providers often fly under the radar unless victims and families happen to take advantage of alternative legal avenues beyond just relying on the authorities.
To be clear, I don’t know what all led to this accident nor what additional steps authorities may be taking to see there are appropriate consequences. In my experience, though, seeing all wrongdoers held accountable after a drunk driving accident doesn’t often happen when authorities are the only ones working to get answers.
