Brazoria County, TX — August 2, 2024, Omar Garza was injured due to an alleged drunk driver accident at around 10:50 p.m. along Highway 288.

According to preliminary details, the accident happened along TX-288 in the area of County Road 68, just south of Iowa Colony.

Investigators said that 37-year-old Omar Alexandro Garza was a passenger in a Dodge Ram pickup going northbound on the highway. The driver of the vehicle somehow left their lane and ended up crashing into the end of a barrier. As a result,Garza reportedly sustained serious injuries while the driver wasn’t hurt. That driver was allegedly under the influence of alcohol at the time of the accident, and authorities recommended charges for intoxication assault.

While charges may sound to some like the end of the story, there’s likely more to this. While I don’t have more information than what’s already public, most late-night accidents involving alcohol also involve negligent alcohol providers. They, too, could be responsible for contributing to the accident.

Simply put, if an alcohol provider such as a bar illegally over-serves someone, they can face criminal investigations, fines, license suspensions, and liability for the resulting injuries. This not only sees held accountable for the wrongs they did, but it also sees them set on the straight-and-narrow before their actions get anyone else hurt. That’s why it’s frustrating that across hundreds of cases that I’ve handled against negligent alcohol providers, few actually got attention from authorities until families took steps to seek out answers they felt authorities weren’t giving them. Are authorities here being more proactive than that, or is this another incident that never really got the attention it needed?
