Commentary by Attorney Michael Grossman
People often think a crash like this is straight-forward just because rear-end collisions are usually due to things like distracted driving, speeding, or following too closely. While those are common factors, it can be just as important to know what caused a crash as it is to know why it happened. Here’s what I mean by that.
With any commercial vehicle accident, it’s important to consider the role a driver’s employer may have played in the crash. Many companies engage in negligent behavior that makes a serious crash all but inevitable. For example, was this driver rushing to meet an unreasonable deadline? Were they not properly qualified to operate a commercial vehicle? Do they have a history of reckless driving? Did the accident involve mechanical issues which happened due to poor maintenance?
Simply put I’ve handled hundreds of commercial vehicle accidents, and many of them involved negligent employers whose actions were just as complicit in getting someone hurt or killed as the reckless drivers involved in the crashes. So if authorities here have only limited their investigations to the crash itself, they could be letting someone off the hook for their role in a serious accident.
