Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that I hope all those injured receive proper care and that investigators are conducting a full review to determine how the incident occurred. A head-on collision involving multiple serious injuries requires a thorough and fact-based investigation. To understand what happened on Almeda Genoa Road, we need to ask three critical questions.
First, did the authorities thoroughly investigate the crash? In a two-vehicle collision like this one, identifying which vehicle entered the opposing lane and why is essential. Were road markings clear and visible? Was there a curve, obstruction or limited visibility that could have contributed to the collision? Were speed limits appropriate for the area and conditions at the time? Investigators should collect physical evidence — such as tire marks, debris fields and vehicle rest positions — and evaluate environmental conditions to reconstruct the crash accurately.
Second, has anyone considered whether a vehicle defect may have played a role in the crash or the severity of the injuries? Both the 2007 Lexus RX 350 and 2018 Ford F-150 should be inspected for any mechanical or safety system failures. Did either vehicle experience a steering or brake malfunction that caused a driver to lose control? Were the airbags and seatbelts functioning as intended for all occupants? In a crash involving multiple serious injuries, especially in older vehicles, it’s important to assess whether all safety equipment performed as it should have to reduce the impact on occupants.
Finally, has all the electronic and digital data related to the crash been collected? Both vehicles are likely equipped with engine control modules that store pre-crash data, including speed, throttle input, braking activity and steering angle. This data can clarify how each vehicle was being operated before the collision and whether either driver took evasive action. Additionally, any available surveillance footage from nearby properties or traffic cameras, along with GPS or mobile device data, can help complete the picture of what led up to the crash. Preserving this information early is essential.
Crashes like this warrant a methodical and transparent investigation. Multiple people were seriously injured, and the community has a right to know whether this crash resulted from a momentary lapse, a mechanical failure, a road design issue or some combination of these factors. Only by asking the right questions and preserving all relevant evidence can we provide a reliable account of what happened and whether it could have been prevented.
