Commentary by Attorney Michael Grossman

When an 18-wheeler jackknifes in traffic, the key question isn’t just what happened, but why it happened. In my experience handling truck accident cases, crashes like this rarely occur without multiple contributing factors that need to be examined.

What caused the truck to jackknife? Jackknifing occurs when a truck’s trailer swings out of alignment with the cab, often due to sudden braking, loss of traction, or an improper steering maneuver. Investigators should review dashcam footage, electronic logging device (ELD) data, and road conditions at the time of the crash to determine what led to the loss of control.

Was the truck traveling at an appropriate speed? Jackknifing can occur when a truck is going too fast for road conditions and has to brake suddenly. If the truck was exceeding a safe speed, investigators should review speed data and witness statements to determine whether excessive speed or following too closely contributed to the crash.

Did broader issues contribute to the wreck? Trucking companies are responsible for ensuring their drivers are properly trained in defensive driving and vehicle control. If the company failed to enforce safe driving practices, allowed an inexperienced driver behind the wheel, or neglected maintenance on the truck’s braking system, those decisions could be relevant to understanding why this crash happened. Investigators should review company policies, driver training records, and past safety violations to determine whether broader issues played a role.

At the end of the day, the most important thing is finding answers. Even if it takes an independent investigation to gather the right evidence, it’s critical to examine every factor to ensure those affected by the crash get the clarity and closure they deserve.
