Commentary by Attorney Michael Grossman
When a motorcycle crosses into the path of an oncoming vehicle, the questions that follow are often left unanswered. A sudden movement like this rarely happens without a cause, and uncovering that cause requires more than just noting the outcome of the collision.
1. Did the authorities thoroughly investigate the crash?
It isn’t clear whether investigators reconstructed the motorcyclist’s path or simply recorded the final positions of the vehicles. A proper investigation would look at whether evasive maneuvers were attempted, whether skid marks or steering changes were present, and whether the rider may have experienced fatigue, distraction, or a medical episode. Without that kind of analysis, the conclusion risks being too quick and too shallow.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
Motorcycles are particularly sensitive to even small mechanical problems. A front tire failure, brake malfunction, or steering defect can quickly force a rider into another lane. These issues may not be obvious at the scene, especially if the bike is badly damaged. Unless a detailed inspection was done, the possibility of a mechanical failure could already be overlooked.
3. Has all the electronic data relating to the crash been collected?
While motorcycles typically capture less electronic data than passenger vehicles, some newer models carry limited event recording systems. In addition, nearby cameras, GPS records, or phone data may provide key insights about the moments leading up to the collision. For the pickup truck, onboard data could also help confirm speed and braking at the time of impact. Without pulling together these pieces, the picture of what happened remains incomplete.
Collisions between motorcycles and larger vehicles often leave more questions than answers. A careful review is the only way to move past assumption and toward understanding the real sequence of events.
Key takeaways:
- A thorough reconstruction is necessary to understand why the motorcycle veered off course.
- Mechanical defects on a motorcycle can cause sudden and uncontrollable movements.
- Digital data, including from the truck and nearby sources, may provide critical context.
