Commentary by Attorney Michael Grossman
Authorities allege that the Toyota driver was under the influence of alcohol at the time. Most recent statements indicate authorities took toxicology tests which have yet to be published. If allegations here are true, that will obviously be a crucial detail. But hopefully authorities have used the time waiting for the results wisely and looked for other crucial evidence. There may be more to this than just a sole alleged drunk driver.
For example, when we have personal injury cases against bars and other alcohol providers, we get all kinds of evidence besides just the drunk driver’s blood-alcohol content. This includes things like credit card statements, texts, and even social media posts which can show where the drunk driver had been drinking and whether or not they were illegally over-served.
Authorities, too, can use that evidence to find those complicit alcohol providers so they can be held accountable. There can be criminal investigations into those providers as well as possible steps from the Texas Alcoholic Beverage Commission to see the alcohol providers fined or otherwise penalized for their actions. That’s why it would be a lot more encouraging if authorities here mentioned at least investigating these possibilities, even if it’s just to rule them out. It’s important that there are appropriate consequences for all responsible parties after a crash like this.
