Commentary by Attorney Michael Grossman
When accidents like this happen, it’s easy for people to assume they stem from a momentary lapse in judgment or bad timing. However, based on my experience, crashes involving large trucks often involve multiple factors that require thorough investigation. This incident on U.S. Highway 181 is no exception.
Given the nature of the crash, investigators will need to determine why the 18-wheeler crossed over the center line and overturned in a ditch. Factors such as driver distraction, fatigue, or mechanical failure must be carefully examined. With a vehicle as large as an 18-wheeler, even a minor issue can lead to a serious accident, especially if the truck loses control. Investigators will also want to assess whether the driver was following proper safety procedures at the time of the crash and whether any potential mechanical issues—such as problems with the brakes or steering—played a role.
If the 18-wheeler was operating under a commercial company, it’s critical to investigate whether the company followed proper safety standards. This includes ensuring the truck was adequately maintained and that the driver was properly trained and following hours-of-service regulations to avoid fatigue. Any failure in these areas could suggest shared responsibility for the wreck.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain vital evidence, it is crucial to consider every factor to ensure that those impacted by the accident receive the clarity and closure they deserve.
