Commentary by Attorney Michael Grossman
One thing to consider with single-vehicle wrecks is that they’re not always a high priority for the authorities. That sometimes means officers jump to conclusions or leave investigations incomplete rather than ensuring that the victim’s loved ones are getting the whole story.
Just a while back, for example, I had a case where authorities jumped to conclusions about a victim not wearing their seatbelt. The family thought that was odd behavior for the victim and asked us to look into things. As it turned out, authorities missed that the seatbelt had a major defect. The victim was wearing it properly, but the defect caused it to fail, and the victim was thrown from their seat. Authorities, not taking the time or effort to consider that possibility, simply saw how things ended up and went with the easy explanation instead of actually considering the facts.
I’m not saying anyone handling this particular accident is going to be equally irresponsible, but that sort of haphazard investigation is a lot more common than people may realize. That’s why families are often better off actively demanding answers from authorities rather than just assuming they’re going to get all the answers on their own. If it’s found authorities have been thorough and looked at all the evidence, then that can give a family much needed peace of mind. Otherwise, if there are still details yet to be addressed, a second look could help bring them to light.
