Commentary by Attorney Michael Grossman

Given the time of day, investigating alcohol is likely standard procedure. If authorities were able to identify alcohol as a factor here, did they also find out where it came from? I’ve handled hundreds of alcohol-related accident cases, and there is usually a negligent alcohol provider involved who unlawfully over-served the driver. They, too, could be responsible.

Even if alcohol wasn’t a factor, though, deadly accidents always present their own challenges. It’s rarely as simple as authorities just finding out who had the right-of-way or pulling cell phone records. Did the vehicles have any defects? Were road conditions a factor? Have they pulled information from the vehicles’ Engine Control Modules? Have they checked nearby residences or businesses for security cameras?

It would surprise folks how often seemingly obvious details can slip through the cracks when authorities do their investigations. Maybe they’ve been more thorough here, but it wouldn’t be the first time if the crash proved better off in the hands of independent investigators.
