Commentary by Attorney Michael Grossman
Police allege that the driver of the northbound vehicle was under the inlfuence of alcohol at the time of the crash. They recommended there be charges for intoxication assault. But there may be more to the story which has yet to be made public: Are authorities looking into where the allegedly drunk driver got their alcohol?
Let me explain why I ask these questions. I handled a personal injury case against a bar not too long ago which had initial details very similar to what I’m seeing here. A drunk driver on his way home from a bar went into oncoming lanes and hit a family’s car, and a young boy in the car was seriously injured. But why was the bar being sued?
Well, the evidence showed that the drunk driver had been illegally over-served by the bar. It was clear that the man had been obviously intoxicated when the establishment continued serving him drinks, and that’s against the law in Texas. As such, they opened themselves up to criminal charges and potential fines for over-serving the driver. To be clear, I was not involved in that, but rather pursuing a claim against the bar for their role in causing the injuries that result from the drunk driver’s actions and the business over-serving him.
Maybe nothing like that happened here, but a late-night crash always raises familiar red flags, and I can’t think of a single good reason not to look into those red flags, even it’s just to rule out something important. Hopefully authorities have been more thorough in their investigations than these initial public statements suggest.
