Commentary by Attorney Michael Grossman
Following any serious accident, it’s important to avoid jumping to conclusions. Even when things may seem straight-forward, or if there appear to be glaring red flags, the investigations need to be thorough to consider all possible factors.
Was there some type of emergency? Did poor lighting or roadway signage contribute to the crash? Was there a driver that was unlawfully over-served by a bar? Did some sort of vehicle defect lead to the crash or result in serious injuries that could have been prevented? Have authorities taken care to map out the crash scene and preserve all the vehicles involved so data can be pulled from their Engine Control Modules? Did any nearby cameras catch the accident on video?
I’ve handled countless accidents across thirty years, and these are the kinds of questions independent accident reconstructionists can reliably answer. Authorities may be able to on their own, but I’ve dealt with too many situations where their answers just didn’t add up, and it took a secondary look to tell the whole story. Maybe authorities authorities have been more thorough here, but that’s up to the evidence to say.
