Lubbock County, TX — April 13, 2024, Marcos Noyola Castanon and one other person were killed in a car accident at about 11:30 p.m. along U.S. 87.

According to authorities, a 33-year-old woman was traveling in a northbound pickup truck in the southbound lanes of U.S. 87 approaching the Farm to Market 1585 overpass when the accident occurred.

Officials indicate that, due to the wrong-way situation, the pickup truck was involved in a head-on collision with a southbound Toyota Corolla occupied by 23-year-old Marcos Noyola Castanon. Both Castanon and the woman from the pickup truck incurred reportedly fatal injuries as a result of the wreck and were declared deceased at the scene.

Commentary by Attorney Michael Grossman

In their statements, authorities allege that the pickup driver on the wrong side of the road had been drinking. Frankly, it would be more surprising if that wasn’t true. Drunk driving is almost always the cause of wrong way accidents. That said, if the allegations are true, are authorities continuing their investigations to find out where the alcohol came from?

People drunk enough to get on the wrong side of a divided roadway are usually extremely intoxicated, and that generally means a bar or a similar establishment illegally over-served the driver and helped them get to that point. Yet authorities often move on once it’s clear there isn’t a drunk driver for them to arrest. This is frustrating because those negligent bars who usually contribute to these wrong-way crashes get to simply continue business as usual like their recklessness didn’t get people killed. Inevitably, that sort of behavior is going to continue putting lives at risk.

If they’re actually held accountable, though, it puts a stop to that. For instance, I can’t recall a single establishment our firm has had a wrongful death case against that didn’t clean up their act. If authorities were equally motivated to seek out these negligent alcohol providers, it would make our roads safer. Instead, negligent alcohol providers tend to only face consequences because a family unsatisfied with the answers they were getting from authorities sought help elsewhere. My hope is authorities here have been more thorough and just haven’t said as much publicly. I wouldn’t hold my breath, though.
