Commentary by Attorney Michael Grossman

When crashes like this happen, people naturally want to know what went wrong. In cases where alcohol is involved, it’s important to ask not just about the driver’s actions, but also where they were drinking before getting behind the wheel.

Under Texas law, it’s illegal for bars and restaurants to serve alcohol to someone who is obviously intoxicated. When they do, and that person causes harm to others, the business that overserved them can be held accountable under dram shop laws. More often than not, however, investigations stop at charging the driver and fail to address whether an alcohol provider contributed to the crash.

If authorities’ allegations about impairment are correct, it’s worth investigating where the driver was before this crash. Answering that question isn’t just about accountability: it’s about ensuring that alcohol providers follow the law and help prevent future tragedies on the road.
