Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that I hope the injured driver is receiving the care he needs and that investigators are taking the necessary steps to understand what led to this incident. A single-vehicle crash involving a car veering off the road and striking a tree can happen for a variety of reasons, many of which are not immediately apparent. To fully understand what occurred on F.M. 2262, we need to ask three critical questions.
First, did the authorities thoroughly investigate the crash? Determining why the vehicle left the roadway is essential. Was there a sharp curve, limited shoulder or other design features that may have contributed? Was the pavement in good condition, and were there any environmental factors — such as debris, poor visibility or slick surfaces — that might have affected the driver’s control? A full assessment of the scene, including vehicle trajectory and point of impact, is necessary to understand whether road conditions played a role.
Second, has anyone looked into whether a vehicle defect may have contributed to the crash or the severity of the injury? The 2016 Buick LaCrosse should be carefully examined for possible issues with its brakes, steering, suspension or tires. Even a minor failure in one of these systems can result in a sudden loss of control. Additionally, given the serious injury involved, investigators should confirm whether the vehicle’s safety systems, such as seatbelts and airbags, functioned properly upon impact. This kind of mechanical evaluation is crucial before the vehicle is repaired or disposed of.
Finally, has all the electronic data related to the crash been collected? The LaCrosse is equipped with an engine control module capable of capturing pre-crash information like vehicle speed, throttle position, brake application and steering input. This data can provide valuable insight into whether the driver attempted to correct course and how the vehicle responded. If GPS data or surveillance footage from nearby properties is available, that may also help clarify what occurred in the seconds leading up to the crash. Timely preservation of this evidence is essential to an accurate investigation.
Crashes like this often appear straightforward, but a thorough investigation may reveal contributing factors that aren’t immediately obvious. A man was seriously injured, and determining whether that outcome was avoidable requires a complete and impartial review of all the available evidence. Asking the right questions and securing the relevant data is the only way to provide the clarity and accountability that such incidents deserve.
