Commentary by Attorney Michael Grossman
When people hear about crashes like this one, it’s easy for them to assume they are a result of simple driver error. However, in my experience, accidents involving large trucks often require thorough investigations to understand all contributing factors.
In this incident, the circumstances leading to the crash are still under investigation. It is essential to determine why the 18-wheeler pulled into the intersection at an unsafe time. Factors such as driver distraction, misjudgment of the Nissan’s speed, or even failure to observe the stop sign must be considered. Each of these elements can significantly impact the dynamics of such accidents.
One critical aspect of this accident is the failure to yield the right of way. Intersections are common sites for collisions, often because one driver fails to yield to oncoming traffic. Investigators should closely examine whether the truck driver adhered to traffic signals and signs, and if the stop sign was clearly visible and not obstructed.
Additionally, the trucking company responsible for the 18-wheeler may share in the responsibility for the accident. If the company failed to enforce safety protocols, properly train their drivers, or ensure that their vehicles were equipped with necessary warning devices, they could be held accountable for their role in the crash.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain vital evidence, it is crucial to consider every factor to ensure that those impacted by the crash receive the clarity and closure they deserve.
