Commentary by Attorney Michael Grossman

When an accident results in the loss of life and serious injuries, a thorough investigation is essential to uncover its causes and contributing factors. In my experience, answering three critical questions is key to ensuring that all relevant details are fully examined.

First, did the authorities conduct a comprehensive investigation of the crash? Determining why the Honda drifted left of center is crucial. Investigators should closely examine evidence from the scene, such as road markings, tire tracks, and the final positions of the vehicles, to understand the sequence of events. Any available witness accounts or surveillance footage from the area can also provide valuable insight into what may have caused the vehicle to leave its lane.

Second, has anyone considered the possibility of mechanical defects or other external factors? While driver behavior often receives initial attention, potential mechanical issues such as brake or steering malfunctions should not be overlooked. Additionally, other factors like roadway design, lighting, or visibility at the time of the accident might have influenced the events. A thorough inspection of both vehicles could help identify whether mechanical problems played a role in the collision.

Finally, has all relevant electronic data been collected? Modern vehicles, including both the Honda and the Ford F-250, often contain event data recorders (EDRs) capable of capturing vital information such as speed, braking, and steering inputs leading up to the crash. Accessing this data, alongside any traffic or dash camera footage that might have been recorded, could provide investigators with a clearer understanding of how the collision unfolded.

Accidents involving serious injuries and the loss of life, such as the passing of Kimberly Kosh-Ruiz, demand a meticulous investigation to identify every contributing factor. By addressing these questions, investigators can work toward providing answers that explain what happened and why. A thorough investigation is the least that can be done to ensure all available information is considered. For those affected by this tragic event, these answers are a vital step toward clarity and closure.
