Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that the people affected deserve clear answers about what happened. A vehicle crossing into oncoming traffic and causing a fatal collision is not something that happens without a cause. While authorities continue their investigation, there are three key questions that must be addressed to fully understand what led to this tragic event.
First, did law enforcement conduct a thorough investigation? In head-on collisions, determining why a vehicle veered into opposing traffic is crucial. Investigators should examine skid marks, roadway conditions, and any potential visual obstructions. Were there any witnesses who saw what happened before the vehicle crossed over? Was the driver attempting to avoid something in the road? Without a detailed accident reconstruction, critical details may be overlooked.
Second, has anyone considered whether a vehicle defect played a role? While it’s often assumed that these types of crashes result from driver error, mechanical failures—such as brake malfunctions, steering defects, or tire blowouts—can also cause a sudden loss of control. If a defect contributed to the crash, identifying it is critical. Unfortunately, these possibilities are often missed unless someone ensures that the vehicle is properly examined before it is scrapped or repaired.
Finally, has all the available electronic data been preserved? The vehicle’s electronic control module (ECM) may contain critical crash-related information, such as speed, braking, and steering input in the moments before impact. Additionally, authorities should check whether any nearby businesses or traffic cameras captured footage of the crash. Another often-overlooked source of evidence is cell phone data—was the driver distracted at the time? Preserving these digital records is crucial in painting a full picture of what happened.
At the end of the day, crashes like this leave families searching for answers. Understanding what caused the vehicle to cross into oncoming traffic is essential—not just for those directly affected, but for the broader community as well. Whether road conditions, a mechanical issue, or another factor played a role, a thorough investigation is necessary to ensure that no potential evidence is overlooked in the search for the truth.
