There isn’t a lot of information available here, but it does stand out that this truck was disabled in a lane of travel. How much attention did authorities give that? It’s important to know why the truck came to a stop and whether or not the truck driver followed proper procedure after stopping. Sometimes, details will show the truck was an unnecessary hazard.
For example, I had a case not long ago where a truck stopped in the middle of a highway, resulting in a serious crash. While authorities didn’t look into that, our independent investigations found some serious mistakes. For one, maintenance records showed the truck hadn’t been worked on in a long time, and the mechanical issue that caused it to stop was completely avoidable. Secondly, the truck driver was there for several minutes yet never bothered putting our flares or cones, which they’re required to do. And lastly, the truck driver didn’t actually need to stop in the middle of the road. They could have continued driving until they found somewhere safe to pull over. Instead, the driver panicked and created a dangerous obstacle for other drivers.
I’m not saying that’s what happened here, just to be clear. Rather, people have a tendency to jump to conclusions when one vehicle is stationary and the other isn’t. There is no automatic equation for who’s responsible in these accidents. Ultimately, the evidence needs to tell the whole story. Have authorities been working to see that happens here?
