It’s possible evidence will show alcohol was not a factor here, but if it was, folks might think that makes things open-and-shut. In reality, alcohol-related crashes can be incredibly complex. It’s not always as simple as seeing a driver face charges. There could be an accomplice: a negligent alcohol provider.

I’ve handled hundreds of alcohol-related cases. It’s incredibly common for local alcohol providers like bar or restaurants to unlawfully over-serve people who are obviously intoxicated. Doing so can expose alcohol providers to potential criminal investigations, fines, or liability for injuries resulting from the intoxication. But if authorities are too focused on the crash itself, they can easily overlook this. In fact, I can’t remember the last time I saw authorities conducting their own investigations into a negligent alcohol provider until after we put the establishment on their radar.

Again, investigations into this crash could show there were other factors that led to the crash. Ultimately, though, it’s important that any wrongdoing that led to the accident—even if it happened hours before the crash itself—is addressed properly.
