Commentary by Attorney Michael Grossman

When someone runs a stop light in the middle of the afternoon and admits they had been drinking, it raises a critical question that often goes unanswered: Where was this person drinking before they got behind the wheel?

Far too often, crash investigations stop once alcohol is identified as a factor, without digging deeper into how that alcohol was obtained. But in Texas, dram shop laws exist for exactly that reason. If a bar or restaurant served this driver while they were already showing signs of intoxication, that establishment may have broken the law, and could share responsibility for what happened next.

Getting answers about where the alcohol came from isn’t just a technicality. It’s a necessary step in holding all responsible parties accountable and reinforcing the message that safe alcohol service is a shared responsibility. Investigating that part of the story is how we help those affected by the crash and work to prevent the next one from happening.
