Giddings, TX — August 4, 2024, Juan Garcia Jr. was killed as the result of a work accident at around 6:30 a.m. along Westwood Lane.
Authorities with OSHA said that the accident happened at apartments located just off the 2600 block of US 290.
It appears that 44-year-old Juan Garcia Jr. was at a construction site on a scissor lift. The lift was allegedly “missing” its door, and Juan Garcia Jr. reportedly fell from the lift. This resulted in fatal injuries.
The OSHA statement listed five alleged violation citations, four of which were labeled “serious.” At this time, additional details about the accident are unavailable.
Commentary by Attorney Michael Grossman
Claims of a scissor lift missing its door are more than a little concerning. How long had it been missing? Why wasn’t it fixed or replaced? Did workers for this employer complain about other similar issues? Were they being pressured to work in unsafe conditions?
My hope is that OSHA went beyond their own narrow scope to help ensure these and other serious questions were answered. The last thing a grieving family needs is to be left in the dark about what led to the death of their loved one. They deserve to know the full story, to see accountability where appropriate, and to know issues will be fixed so other families don’t have to suffer the same hardships they did.
