Commentary by Attorney Michael Grossman

While there isn’t a lot of information available about this accident, experience has shown me that one thing remains consistent between fatal work accidents. Texas has the most complex work fatality laws of any other state in the country. Despite what people may think, there is not always a guaranteed path to getting a family the benefits they need following an accident. Not only that, but when there is a path for those benefits, they can act more like constraints unless there is clear evidence an employer’s egregious behavior contributed to the accident. Ultimately, this leads to a complex legal maze that requires extensive experience and legal strategizing to navigate. The sooner steps are taken to ensure a worker’s family has access to those resources, the sooner they can work toward a fair resolution.
