Commentary by Attorney Michael Grossman
When people hear about a fatal accident like this one, they often assume it’s a straightforward case of driver error. In my experience, however, it’s rarely that simple. Accidents like these typically involve multiple factors that need careful examination.
First, we need to understand what led to the collision. If the truck was the vehicle at fault in this accident, was the truck driver distracted, speeding, or perhaps fatigued? Gathering data from vehicle event recorders, reviewing traffic camera footage, and analyzing witness statements can provide crucial insights into these questions.
Next, the trucking company’s role should be scrutinized. Was the truck driver properly trained and adhering to company safety protocols? Trucking companies have a duty to ensure their drivers are well-prepared for the challenges of the road. If the company cut corners on training or pushed the driver to meet unrealistic deadlines, it could share responsibility for the crash.
Additionally, it’s important to examine the truck’s condition. Was it properly maintained? Mechanical failures, such as brake malfunctions or tire blowouts, can contribute significantly to accidents. Reviewing maintenance records and conducting thorough inspections of the vehicle can reveal whether such issues played a role.
In no way am I trying to insinuate that I know any more about this crash than is generally known by the public; it’s just that, in my three decades of experience with litigating truck accidents, I have learned that investigations must go beyond the crash scene to uncover the truth. This includes looking into the truck driver’s logs, examining the driving history, and possibly consulting with accident reconstruction experts. Only with a comprehensive approach can we ensure that all responsible parties are held accountable and that measures are taken to prevent similar accidents in the future.
