Commentary by Attorney Michael Grossman
On the one hand, it’s impossible to ignore the obvious red flags that alcohol led to this crash. I’ve had hundreds of cases involving drunk drivers, and a large portion of them were at this time and on this day of the week. That’s why it’s important to consider where the drivers were coming from, if alcohol was a factor, and if a local establishment may be involved due to illegally over-serving the person responsible for the accident.
That said, as likely as that is, it’s also important to consider there may have been extenuating circumstances. Was there an issue with signage or lighting? Was there an emergency of some kind? Does this particular road see frequent incidents of people accidentally going the wrong way? At the end of the day, the evidence needs to be able to speak for itself. That’s only going to happen if investigators are prudent enough to consider even unlikely scenarios, even if it’s just to rule them out.
