Commentary by Attorney Michael Grossman
Collisions between cars and motorcycles are almost always severe, and when speed is involved, the consequences are even more devastating. Still, the question remains: have investigators done enough to uncover exactly how this crash happened?
1. Did the authorities thoroughly investigate the crash?
In a case where a motorcycle is struck from behind or the side, it’s critical that investigators go beyond the obvious. That means measuring skid marks, documenting vehicle positions, and reconstructing speed and impact angles. Did the driver of the Honda have a clear line of travel before the crash? Was there any evidence the motorcyclist tried to evade? Without a detailed reconstruction, those questions remain unanswered.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
When a vehicle is reportedly traveling at a high rate of speed, it’s tempting to assume reckless driving alone caused the collision. But a mechanical failure—faulty brakes, a stuck accelerator, or a malfunctioning electronic system—could also contribute. Without a thorough inspection of the Honda, it’s impossible to know whether this was purely driver behavior or if the machine itself played a role.
3. Has all the electronic data relating to the crash been collected?
Modern vehicles carry data recorders that log speed, braking, and steering inputs seconds before a crash. Phones, GPS devices, and traffic cameras near the overpass may also provide vital information about how fast the Honda was moving and what happened in the final moments. If this evidence isn’t secured quickly, an important opportunity to verify what really occurred could be lost.
When a motorcyclist is killed in a collision, it’s not enough to stop at the surface explanation. Only by asking the hard questions can the real chain of events be brought to light.
Takeaways:
- It’s unclear whether investigators reconstructed the full sequence of the collision.
- A potential defect in the Honda may not have been examined.
- Vehicle data, devices, and nearby cameras could confirm key details if reviewed.
