Commentary by Attorney Michael Grossman

If authorities’ allegations are accurate that the driver of the Chrysler was under the influence of alcohol at the time of this collision, it’s important for investigators to examine how the driver became intoxicated. Texas dram shop law provides a potential avenue of accountability for alcohol providers, such as bars, restaurants, or liquor stores, if they over-serve an obviously intoxicated individual who later causes harm as a result of that intoxication.

If that sounds unusual, it’s probably because authorities rarely ever bring up this area of the law. I’ve handled hundreds of cases against negligent alcohol providers for their role in serious accidents. It would shock people how often negligent alcohol providers completely flew under the radar until our more thorough independent investigations brought them to light. When victims and families demand more from authorities, they either help encourage authorities to take their own action, or they realize there needs to be help from the outside making sure all wrongdoers face appropriate consequences. Whether or not such steps are being taken here remains to be seen.
