Commentary by Attorney Michael Grossman
When accidents like this occur, it’s natural for people to focus on the most visible details—in this case, the collision between a passenger car and an 18-wheeler. However, as someone with decades of experience handling commercial vehicle cases, I’ve learned that the true story of such accidents often lies beneath the surface. Understanding what led to this crash requires a thorough investigation into the factors behind the truck’s apparent failure to stay in its lane.
A key area of inquiry is the condition of the truck itself. Was the Kenworth properly maintained and roadworthy at the time of the accident? Issues like worn tires, brake failures, or steering malfunctions can lead to loss of control and lane departures. Investigators should also examine whether the trailer was loaded properly, as unbalanced or unsecured cargo can affect a truck’s handling, particularly during turns or braking.
The role of the trucking company must also be scrutinized. Companies are responsible for ensuring their vehicles are in safe working condition and their drivers are adequately trained and prepared to handle the demands of the road. Did this company have a robust maintenance program in place? Were their drivers regularly monitored for compliance with safety regulations? Additionally, the company’s scheduling and dispatch policies should be examined to determine whether unrealistic delivery deadlines or other pressures contributed to the incident.
Driver factors are another critical avenue of investigation. Was the truck driver adequately rested and alert? Fatigue remains a significant problem in the trucking industry, despite regulations meant to prevent it. Investigators should also explore whether the driver was impaired, distracted, or otherwise unable to maintain control of the vehicle. If poor decision-making or a lapse in attention led to the crash, determining the reasons for that failure is essential.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure that those impacted by the incident receive the clarity and closure they deserve.
