Commentary by Attorney Michael Grossman
When I see a report like this, my first thought is that I hope the injured driver and his family get the answers they need about what caused this crash. A single-vehicle accident may seem straightforward, but in my experience, crashes like this are often more complex than they appear. To truly understand what happened, there are three critical questions that must be asked.
First, did the authorities thoroughly investigate the crash? A proper investigation should include accident reconstruction, roadway analysis, and a review of potential contributing factors like weather, road conditions or visibility. Since this crash happened after 1 a.m., factors like driver fatigue or poor lighting conditions could be relevant. Investigators should also look for any potential hazards on the roadway, such as debris or slick surfaces, that could have contributed to the driver losing control.
Second, has anyone looked into the possibility that a vehicle defect caused the crash? The Audi TT is a performance-oriented vehicle, and at over 20 years old, mechanical issues like brake failure, steering malfunctions or suspension defects could be factors. It’s worth considering whether a tire blowout or stability control failure played a role in the vehicle losing control. Unfortunately, most crash investigations don’t include a forensic vehicle inspection, which means potential defects could go unnoticed, especially if the vehicle is repaired or scrapped before it can be examined by an expert.
Third, has all the electronic data relating to the crash been collected? Many vehicles, including older models like the Audi TT, have an engine control module that can capture critical crash data such as speed, braking and steering inputs. Additionally, nearby surveillance cameras, dashcams or even cell phone data could provide crucial context. Without these pieces of evidence, investigators may be left with an incomplete understanding of what led to the crash.
At the end of the day, crashes like this leave those involved with pressing questions. The least the community can do is ensure that every effort is made to uncover the full truth.
