Commentary by Attorney Michael Grossman
People tend to think situations like this are open-and-shut. However, intoxicated drivers bring up the possibility of negligent alcohol providers, and that should be included in any investigation where evidence shows alcohol was a factor.
Simply put, bars and other establishments can be responsible for contributing to an accident caused by someone whom they unlawfully over-served. Not only does this help see full accountability for an accident, but it also helps make the roads safer for everyone.
So while alcohol has not specifically been confirmed here yet, it’s important to understand why a seemingly open-and-shut situation might actually be quite the challenging path forward for the victims and families involved.
