Commentary by Attorney Michael Grossman

Some may not think there would be more to tell, considering this is a dangerous place for pedestrians to be. But I’ve always discouraged people from jumping to conclusions, and an accident like this shouldn’t be an exception.

As a matter of fact, I had a wrongful death case not long ago that had initial reports very similar to these. In that case, a man was hit on a freeway off-ramp early in the morning. A lot of people just blamed the victim entirely, but our investigations showed that he had been illegally over-served by a local establishment.

The man had been out drinking with friends, and the business continued to serve him beyond the point it was clear they were doing so illegally. While the victim was wise enough not to get behind the wheel, his intoxicated led to him becoming disoriented. He got lost trying to walk home and ended up wandering into traffic, and he died as a result. So what people might have just called someone being irresponsible turned out to be the result of a victim being recklessly over-served to the point it led to his death.

Just to be clear, I’m not bringing that up to say that happened here. It’s just a possibility most wouldn’t consider unless they’d seen it happen before. There could be a lot more to this story than what’s available to the public right now.
