Commentary by Attorney Michael Grossman
With single-vehicle wrecks, a primary concern is simply ensuring the accident gets the attention it needs. Frankly, authorities sometimes see accidents like this as a low priority, and that can lead them to jump to conclusions and move on without actually being thorough. That’s why it can be helpful to consider a few important details early on.
- Was the crash scene properly and thoroughly documented?
It’s easy for investigators to miss or misinterpret physical evidence if they lack proper tools, time, or training. Details like vehicle position, skid marks, and roadway conditions are critical for understanding what happened, so making sure there are means to properly investigate them is crucial. - Was the vehicle examined for any potential defects?
Defects in brakes, steering, or even tire condition can lead to sudden loss of control. If seatbelts or airbags didn’t function as they should have, that can explain the severity of the injuries. These issues require close inspection, ideally before the vehicle is moved or altered. - Was crash-related electronic data preserved?
Many modern vehicles store pre-crash data like speed, braking, and steering inputs. That information, combined with possible phone records or surveillance footage, can help clarify who was driving and how the crash unfolded—but only if it’s collected promptly.
Asking these questions can help ensure the investigation isn’t shaped by assumptions or early impressions, but by solid evidence and careful work. That way, those involved in the accident can at least rest assured all sides of the story are being told fairly.
