Commentary by Attorney Michael Grossman

While there aren’t many other details about the accident confirmed, something does stand out to me here. Details suggest an 18-wheeler was able to change lanes before hitting the victim, and it suggests that driver was able to avoid the accident. Is that because the victim was visible and reasonably avoidable? If so, it’s much harder to avoid an accident in a commercial truck than in a typical passenger vehicle. So why wasn’t the second driver able to avoid the collision? Were there extenuating circumstances, or was that driver engaging in negligent behavior? If nothing else, I’d say those are questions worth answering before anyone could say these details are telling the whole story.
