Commentary by Attorney Michael Grossman

When it comes to accidents allegedly involving alcohol, people may think things are open-and-shut. In reality, they can be quite a bit more complex than a typical crash. It’s not always just about seeing a drunk driver held accountable for their actions—though that is important. In many situations, there is a complicit alcohol provider who may also be responsible for contributing to the accident.

In Texas, if an alcohol provider serves someone who is obviously intoxicated, they can potentially face criminal investigations, fines, suspended licenses, or liability for injuries resulting from the intoxication. Too often, though, investigations will focus solely on the drunk drivers, meaning those negligent alcohol providers can slip under the radar to continue putting people at risk.

So when I see an accident like this, authorities simply calling out a driver’s alleged intoxication isn’t enough on its own. They also should be looking into where that alcohol came from and whether or not all parties are going to be held appropriately accountable for the harm done to the victims. It remains to be seen if authorities here have taken those steps.
