Commentary by Attorney Michael Grossman

When it comes to motorcycle accidents, it’s important to take any early details with a grain of salt. They’re not often taken seriously, and a lot of people are quick to blame motorcyclists without actually knowing all of the facts. Obviously, people make mistakes, but that’s true for people driving cars, trucks, motorcycles, golf carts, or any other kind of vehicle one can think of.

That’s why it’s important to also consider the possibility the victim couldn’t avoid the accident. Were there objects in the road? Did a tire blow out? Is there an issue with lighting or signage here? Did the motorcycle have some kind of defect? Likely or not, the evidence needs to be able to speak for itself. It’s simply a matter of whether or not authorities are actually getting that evidence or if they, too, are letting their bias get in the way.
