Commentary by Attorney Michael Grossman

After serious crashes, it’s natural to focus on what happened in the moment. But sometimes the most important answers lie in the steps investigators didn’t take. When someone’s badly hurt, it’s worth asking whether everything that could be done to understand the crash actually was.

Did the authorities thoroughly investigate the crash? Any time two vehicles collide head-on or at angles that cause serious injuries, it raises questions about how thoroughly the scene was analyzed. Was a full reconstruction done to determine each vehicle’s position and speed? Were the drivers’ actions leading up to the impact reviewed with precision, or just based on surface observations? The tools and time needed for a deep dive aren’t always used, and crash scenes in rural areas can face rushed assessments due to limited resources or training.

Has anyone looked into the possibility that a vehicle defect caused the crash? When a newer model truck is involved, like a 2025 pickup, it’s fair to wonder whether all of its systems worked properly. Sudden steering issues, braking system failures or sensor errors don’t always leave obvious clues at the scene. That’s why a full mechanical inspection is so important, especially if one driver couldn’t avoid the crash while the other walked away unscathed. Defects don’t announce themselves; someone has to go looking.

Has all the electronic data relating to the crash been collected? Modern pickups are loaded with electronic systems that track what the vehicle was doing seconds before impact. Speed, braking force, steering input; it’s all there. Add in potential phone data and nearby cameras, and a much clearer picture can emerge, if someone thinks to gather it. In cases with major injuries, that step shouldn’t be skipped.

As easy as it is to see a crash as a closed book once the debris is cleared, serious injuries deserve a deeper look. It’s often the unasked questions that point to what really went wrong, and how to prevent it from happening again.

Key Takeaways:

  • Surface-level crash investigations often miss key details.
  • Vehicle malfunctions don’t always leave visible signs.
  • Electronic data from modern vehicles can explain exactly what happened.
