Commentary by Attorney Michael Grossman
When accidents like this happen, it’s easy for people to assume they stem from simple mistakes or lapses in attention. However, based on my experience, crashes involving large trucks often involve multiple factors that need thorough investigation. This collision is no exception.
The primary focus of the investigation should be on why the Kenworth truck didn’t stop in time. Was the driver distracted, fatigued, or speeding? Large trucks, especially those hauling trailers, require significantly more distance to come to a safe stop, so understanding what caused this failure is crucial.
Driver fatigue is often a significant factor in incidents like this. Commercial truck drivers face long hours and demanding schedules, which can lead to exhaustion behind the wheel. Fatigue severely impairs reaction time and decision-making abilities, which could explain why the driver was unable to stop for the red light. Investigators should review the driver’s hours-of-service records and look into whether proper rest regulations were followed.
If the Kenworth was operating under a commercial company, it’s also essential to examine the company’s role in ensuring the vehicle was properly maintained and the driver was adequately trained. Trucks carrying heavy loads require regular maintenance, and any failure in the vehicle’s braking system or load management could have contributed to the crash. Additionally, if the company placed unrealistic demands on the driver’s schedule, it could share responsibility for the wreck.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain vital evidence, it is crucial to consider every factor to ensure that those impacted by the crash receive the clarity and closure they deserve.
