Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that I hope the loved ones of those involved receive the answers they deserve. A single-vehicle crash like this may seem straightforward, but in my experience, there’s often more to the story than meets the eye. To truly understand what happened, there are three critical questions that must be addressed.
First, have authorities thoroughly investigated the crash? Law enforcement typically documents the scene, speaks to witnesses, and assesses potential contributing factors like weather or road conditions. However, a deeper analysis is often necessary to determine why the vehicle left the roadway in the first place. Were there any hazards on SR 152 that could have caused a loss of control? Was there evidence of evasive action, such as tire marks indicating an attempt to regain control? Without a detailed reconstruction of the crash, key details could go unnoticed.
Second, has anyone looked into the possibility of a vehicle defect? It’s easy to assume that losing control was due to driver error, but mechanical failures—such as brake issues, steering malfunctions, or tire blowouts—can also lead to crashes. Vehicle defects are one of the most overlooked factors in crash investigations, mainly because diagnosing them requires forensic examination. If the vehicle is quickly scrapped or repaired, vital evidence may be lost, making it impossible to determine whether a malfunction contributed to the wreck.
Third, has all electronic data relating to the crash been collected? Modern vehicles store crucial information in their electronic control module (ECM), which can provide insights into speed, braking, and steering input in the moments before impact. Additionally, surveillance footage from the gas station or nearby businesses could shed light on what happened. Cell phone records could also help determine if any external distractions played a role. If this evidence isn’t secured quickly, it could be lost forever, leaving important questions unanswered.
At the end of the day, the family of the person involved, like all families affected by serious crashes, deserves to know exactly what happened. If the official investigation leaves any gaps, independent experts may be needed to ensure that every possible factor is considered. Whether the cause was environmental, mechanical, or something else entirely, the community owes it to those affected to make sure the full story comes to light.
