Commentary by Attorney Michael Grossman
When a crash between a passenger car and a dump truck leaves someone trapped in the wreckage, the obvious question is how such a severe impact happened—especially at an intersection. Intersections are places where everyone on the road has a duty to slow down, observe traffic signals, and make careful decisions. So when a collision like this occurs, especially one serious enough to require extrication, it’s worth asking whether everyone involved lived up to that responsibility—particularly the driver of the commercial vehicle.
Dump trucks are large, heavy, and slow to stop. That means their drivers are held to a higher standard of caution, especially in places where cars, cyclists, and pedestrians are likely to appear. Was the truck speeding? Did the driver fail to yield or misjudge the timing of a turn? Did the truck run a red light or stop sign? These are the kinds of details that often don’t make it into the early reports, but they’re crucial to understanding how the crash unfolded.
It’s also important to consider the company behind the dump truck. Was the driver trained to handle tight turns and busy intersections? Did the company maintain the truck in good working order, including brakes and steering systems? I’ve seen more than a few cases where a company’s failure to provide proper training or upkeep turned an avoidable situation into a serious crash. And in some cases, drivers are pushed to complete more loads in less time, which can lead to rushing through intersections without taking the time to look twice.
Getting to the bottom of a crash like this means asking the right questions and refusing to stop at surface-level explanations. Serious wrecks deserve serious investigation, not assumptions. Understanding how the dump truck was being operated, whether the driver followed traffic rules, and whether the company upheld its safety obligations is key to figuring out what might have happened. Getting clear answers to these questions is the least that can be done to help those affected find the clarity and closure they deserve.
