Commentary by Attorney Michael Grossman

Clearly, there’s not much information about this crash available right now. Every crash deserves a thorough investigation to uncover the truth, yet important details can easily be missed without asking the right questions. To ensure all possibilities are explored, some key questions can help victims and families understand what kind of answers they should expect to see:

1. How Thorough Are Authorities Being In Their Investigations?

It can take a lot of time, tools, and experience to investigate car wrecks, even seemingly straight-forward ones. Departments don’t always provide officers with the resources they need to conduct such thorough investigations. Investigations that are rushed or limited in scope risk overlooking critical evidence. Factors like poor road conditions, inadequate signage, or other hazards may never come to light if tools are insufficient or out-dated. Knowing how much effort investigators are dedicating to a crash helps to ensure that the investigation goes beyond surface-level conclusions.

2. Did Any Vehicle Defects Contribute to the Accident?

Mechanical failures and advanced safety system malfunctions are commonly overlooked potential causes of crashes. Crucial evidence can slip through the cracks unless someone with the right training and state-of-the-art tools examines the vehicle. Ensuring that a thorough inspection takes place is key to ruling out—or confirming—these issues as contributing factors.

3. Have Authorities Gathered and Examined All Electronic Data?

Modern vehicles record crucial information in their Electronic Control Module (ECM), such as speed, braking, and steering input. Cell phones, aside from the obvious cell phone records, can also provide things like GPS data. There could be nearby doorbell cameras or security cameras that caught the crash on video. As obvious as these details may seem, I frequently see examples of officers overlooking video evidence that could shed light on the exact moments surrounding the crash.

Ultimately, these questions can help people gauge how a crash investigation is being handled. If officers are able to provide clear, sensible answers, it’s likely because they’re doing a good job. Otherwise, if things aren’t adding up, it may be that a second set of eyes is needed to ensure nothing important goes overlooked.
