Commentary by Attorney Michael Grossman
Folks tend to assume single-vehicle wrecks like this are open-and-shut since there’s just one vehicle involved. In reality, every crash can involve unique factors that require careful, thorough analysis. Whether or not authorities actually take the time to conduct such an analysis, though, is where the challenge arises. I’ve handled all kinds of accidents across decades of work, and the reality is authorities don’t often look into anything except the most obvious, common possible factors. This is when important details slip through the cracks.
For example, have authorities considered possible defects? Did the vehicle lose control from a tire failure? Did the steering mechanism or braking system malfunction? Did the vehicle perform up to modern safety standards in the rollover? Did the victims’ seatbelts and airbags work properly? At the end of the day, it can take countless specialized tools and years of experience to look into those possibilities. If authorities are only concerned with things like speed or distracted driving, they could easily miss something that more thorough independent accident reconstructionists could bring to light.
So while it’s not clear what did or didn’t happen here, there are always potential factors that victims and families should keep in mind. That way, if they find authorities aren’t able to give them satisfactory answers, they can take steps to get the evidence in the hands of investigators who will.
