Montgomery County, TX — August 18, 2024, Denys Nykyforov was injured due to a vehicle versus pedestrian accident at around 6:30 p.m. along Riley Fuzzel Road.
Authorities said in preliminary statements that the accident happened in the Spring area near the intersection of Grand Parkway/Riley Fuzzel Road and Spring Trails Ridge.

According to officials, 35-year-old Denys Nykyforov was on foot outside of a broken-down vehicle on eastbound Riley Fuzzel. While there, authorities say a Mercedes-Benz crashed into the broken-down vehicle, hitting Nykyforov in the process. Nykyforov sustained serious injuries. The driver allegedly had been drinking, but it’s unconfirmed if intoxication was a factor in the accident.

If alcohol was a factor here as authorities suspected, folks might assume that would make things open-and-shut. The reality, though, is alcohol-related accidents can be incredibly complex if handled properly. That’s because a lot of them involve drivers who were unlawfully over-served by an alcohol provider, such as a bar or a restaurant. Those establishments can also face consequences for their actions in the form of potential criminal investigations, fines, license suspensions, and liability for the victims’ injuries.
Too often, though, these details slip through the cracks. I’ve handled hundreds of cases against negligent alcohol providers. It’s not the sort of thing that tends to make it onto the authorities’ radar. Generally, negligent alcohol providers are let off the hook unless the victims and families they harmed are motivated to explore legal avenues independent of the police. That’s why I have to wonder how thorough investigations into this accident are an whether or not authorities are being too narrow in their efforts to see there are appropriate consequences for the accident.
