Commentary by Attorney Michael Grossman
When crashes like this one occur, people often assume they result from a driver not paying attention or misjudging their speed. However, accidents involving large trucks frequently involve a combination of factors that require careful investigation to fully understand what happened and why.
What caused the Dodge to collide with the rear of the Mack truck’s trailer? Did the driver of the SUV fail to notice the truck slowing down in time? Were there visibility issues, such as inadequate lighting on the trailer or the surrounding area, that made the situation more hazardous? These questions are central to understanding how events unfolded and whether the collision was truly unavoidable.
The condition and operation of the Mack truck also warrant scrutiny. Large trailers are required to have functioning lights, reflectors, and conspicuous markings to ensure they are visible to other drivers, especially when slowing down or turning. If any of these were missing or malfunctioning, it could have played a significant role in the crash. Additionally, investigators should confirm whether the truck driver executed the left turn safely and in compliance with traffic regulations.
The trucking company responsible for the Mack truck should also be considered in the investigation. Was the truck properly maintained, ensuring all safety equipment was in good working order? Was the driver adequately trained and well-rested, or could fatigue or insufficient preparation have factored into the incident? Companies have a duty to maintain their vehicles and ensure their drivers operate them safely, and any lapses in those responsibilities may point to preventable causes.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the accident. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure those impacted by the incident receive the clarity and closure they deserve.
